Houston TV Station Fights Subpoena for Unaired Footage

An interesting case is unfolding in Houston.

Mike McDaniel writes in The Houston Chronicle:

In a case that could have a major impact on freedom of the press in Texas, a Harris County judge today will consider whether the District Attorney's Office is entitled to raw video for a story a local TV station has not aired.

Russell Turbeville, chief of the district attorney's consumer fraud division, has subpoenaed KPRC-TV (Channel 2), seeking video it collected while reporter Amy Davis was investigating a possible story about home loans.

A motion to dismiss the subpoena will be heard in state District Judge Mark Kent Ellis' 351st District Court.

TV stations routinely honor subpoenas and make available copies of stories that have aired. In this case, however, the District Attorney's Office wants unedited video for a story that has never aired.
